JINS VIETNAM CO., LTD. establishes this Privacy Policy to ensure the proper handling of personal data as an organization in accordance with Vietnamese legal frameworks, including Decree No. 13/2023/ND-CP, Data Law No. 60/2024/QH15, Cybersecurity Law No. 24/2018/QH14, Electronic Transactions Law No. 20/2023/QH15, Civil Law No. 91/2015/QH13, and other applicable laws and regulations.

2.COMPLIANCE WITH APPLICABLE LAWS AND GUIDELINES

JINS VIETNAM CO., LTD. will handle personal data appropriately, complying with Decree No. 13/2023/ND-CP, Data Law No. 60/2024/QH15, Cybersecurity Law No. 24/2018/QH14, Electronic Transactions Law No. 20/2023/QH15, Civil Law No. 91/2015/QH13, and other current related laws and guidelines.

3.COLLECTION AND USE OF PERSONAL DATA

When collecting personal data, JINS VIETNAM CO., LTD. obtains prior consent from the individual and publicly announces or notifies the purpose of use (including through this Privacy Policy). When collecting personal data directly from individuals through contracts or other documents (including electronic records), the purpose of use is clearly specified in advance, and data is collected through lawful and fair means.

JINS VIETNAM CO., LTD. uses personal data appropriately within the scope necessary to achieve the stated purposes of use.

4.PURPOSES FOR COLLECTING PERSONAL DATA

JINS VIETNAM CO., LTD. collects and uses personal data for the following purposes:

(1)Personal Data Pertaining to Customers

  • For product and service planning, research & development, and quality improvement. This includes:
  • Collecting (including from third parties), recording (including storage), and analyzing customer attribute information and behavioral history to understand preferences, and using this for product and service planning, development, and quality improvement.
  • Improving the customer experience across digital services provided by JINS Group companies (such as websites and mobile applications).
  • For providing products and services. This includes:
  • Verifying customer identity and personal authentication.
  • Processing product sales, issuing invoices, providing related services, managing payments and refunds, and handling various communications.
  • Collecting (including from third parties), recording (including storage), and analyzing customer purchase history, attribute information, and behavioral history to provide optimal products and services.
  • Contacting winners of customer campaigns and sending prizes.
  • For providing information about products and services. This includes:
  • Delivering advertisements and information about products, services, and campaigns via mail, email, etc.
  • Collecting (including from third parties), recording (including storage), and analyzing customer website browsing history, purchase history, and attribute information to provide relevant product/service information and deliver advertisements (including through advertising service providers).
  • Collecting, recording (including storage), and analyzing customer behavioral images from in-store cameras or applications and conducting marketing activities such as recommending products and providing other information based on this analysis.
  • For responding to inquiries, complaints, and general communications. This includes:
  • Responding to, confirming, and recording (including storage) customer inquiries, consultations, complaints, repairs, and support requests.
  • For ensuring the secure provision of JINS VIETNAM CO., LTD.'s products and services and for fraud prevention. This includes:
  • Identifying users who violate terms of service and notifying them.
  • Investigating, detecting, preventing, and responding to fraudulent activities such as scams and unauthorized access that exploit services.
  • Using images and audio data captured by security cameras for crime prevention purposes.

(2)Personal Data Pertaining to Business Partners (including officers and employees of corporate partners)

  • Necessary business communications, contract negotiation, execution, and performance, business discussions, invoicing, and payments.

(3)Personal Data Pertaining to Shareholders (including officers and employees of corporate shareholders)

  • Managing shareholders, such as preparing records based on various laws and regulations.

(4)Personal Data Pertaining to Recruitment Applicants

  • For managing recruitment applicants and various communications. This includes:
  • Communicating with and providing information to recruitment applicants, and other uses necessary for recruitment activities. If hired, the applicant's personal data will be used for human resources and labor management.

(5)Personal Data Pertaining to Employees

  • For human resources and labor management. This includes:
  • Business communications to employees.
  • Payment of employee compensation (wages, bonuses, allowances, etc.), performance of human resources and labor management, and provision of welfare benefits.
  • Employee health management.

Note on Third-Party Provision: JINS VIETNAM CO., LTD. may provide acquired personal data to third parties as described in Section 7 below.

5.HANDLING OF SENSITIVE PERSONAL DATA

JINS VIETNAM CO., LTD. may collect sensitive personal data for the purposes outlined in Sections 4(1) through 4(5) above, provided that prior consent from the individual is obtained and strict handling standards, in accordance with statutory classifications, are observed beyond those for general personal data.

6.JOINT USE OF PERSONAL DATA

JINS VIETNAM CO., LTD., its parent company, and group affiliates listed in Section 1 above (collectively, "Joint Use Entities") may jointly use collected personal data among JINS Group companies to conduct integrated business operations. This joint use occurs provided that statutory conditions are met (including obtaining prior consent from the individual), mandatory procedures (such as personal data processing impact assessments and personal data provision impact assessments for foreign third parties) are implemented, and compliance with orders from public security and other competent authorities is maintained.

All personal data collected by the Joint Use Entities, including but not limited to: Personal identification numbers, name, gender, date of birth(age), address (including postal code), contact information (phone number, FAX number, email address, etc.), member ID/password, affiliated company/department/position, identifiable voice/video, product purchase history, and prescription/vision correction values.

(2)Scope of Joint Use Entities

Limited to the entities specified in Section 1 above.

(3)Purposes of Use

The purposes of use are described in Sections 4(1) through 4(5) above.

(4)Name, Address, and Representative of the Company Responsible for Personal Data Management

JINS VIETNAM CO., LTD. is responsible for the jointly used personal data. For the name, address, and representative of JINS VIETNAM CO., LTD., please refer to Section 1 above. For inquiries regarding joint use, please contact the inquiry desk listed in Section 10 below.

7.DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

JINS VIETNAM CO., LTD. may disclose personal data to third parties after obtaining prior consent from the individual. Additionally, personal data may be disclosed to third parties without the individual's consent in any of the following cases as permitted by law:

  • When necessary to protect the life, body, or property of the individual or a third party, and it is difficult to obtain the individual's consent.
  • When there is a disclosure request from a government agency based on laws and regulations.
  • When urgent action is required for significant public interest, such as in cases of disaster, infectious diseases, or national security.
  • When necessary for the fulfillment of a contract with the user.
  • When required by national administrative agencies for business purposes under law.
  • Other cases where the individual has publicly disclosed the information themselves, and its use aligns with the purpose of public disclosure.

When providing personal data to a third party, whether domestic or foreign, JINS VIETNAM CO., LTD. will contractually impose on that third party personal data protection obligations equivalent to or exceeding those of JINS VIETNAM CO., LTD.. Specifically, such contracts will stipulate that personal data shall be handled within the scope of the specified purpose of use, prohibit inappropriate use, require necessary and appropriate security control measures, require necessary and appropriate supervision of employees, prohibit re-consignment, and prohibit the provision of personal data to further third parties.

When providing personal data to a third party located in a foreign country, JINS VIETNAM CO., LTD. will comply with mandatory procedures based on relevant laws and regulations, such as impact assessment reports concerning the provision of personal data to third parties located abroad, to the extent that statutory conditions are met.

Additionally, JINS VIETNAM CO., LTD. will conclude a contract with the third party after understanding the personal data protection system in that foreign country.

8.INFORMATION ON SECURITY CONTROL MEASURES

JINS VIETNAM CO., LTD. implements necessary and appropriate security control measures for personal data (including personal data that JINS VIETNAM CO., LTD. has collected or intends to collect) to prevent leakage, loss, or damage, and for its overall management.

Furthermore, JINS VIETNAM CO., LTD. provides necessary and appropriate supervision to employees and contractors (including sub-contractors) who handle personal data. The main measures include:

Privacy Policy Development:

This Privacy Policy has been developed to ensure the proper handling of personal data, covering "Compliance with Relevant Laws and Guidelines," "Inquiry and Complaint Handling," and other relevant aspects.

Establishment of Personal Data Handling Rules:

"Personal Data Protection Regulations" have been established for each stage of handling, including collection, use, storage, provision, deletion, and disposal, specifying handling methods, responsible personnel, and their duties.

Organizational Security Measures:

A personal data protection officer has been appointed, the scope of personal data handled by employees and the specific employees responsible has been clearly defined, and a reporting system to the personal data protection officer is in place for any identified facts or indications of violations of personal data protection laws or regulations. Regular internal self-inspections of personal data handling status are conducted, along with audits by other departments or external parties.

Personnel Security Measures:

Employees receive regular training on points to note regarding personal data handling. Confidentiality obligations concerning personal data are included in the employment regulations.

Physical Security Measures:

In areas where personal data is handled, access control for employees and restrictions on bringing in equipment are implemented. Measures are also in place to prevent unauthorized persons from viewing personal data. Steps are taken to prevent theft or loss of equipment, electronic media, and documents handling personal data, and measures are implemented to ensure personal data cannot be easily identified when these items are transported, including within the office.

Technical Security Measures:

Access controls are implemented to limit the scope of personnel and the personal data databases they can access. Information systems that handle personal data are protected by mechanisms against unauthorized external access or malicious software.

Understanding External Environments:

JINS VIETNAM CO., LTD. may provide personal information to third parties located in foreign countries (countries or regions outside of Japan). This includes outsourcing and joint use. In such cases, the security control measures are as described in Section 7.

9.INDIVIDUAL RIGHTS REGARDING PERSONAL DATA (ACCESS, CORRECTION, ETC.)

When JINS VIETNAM CO., LTD. receives requests for personal data inquiry, correction, suspension of use, or deletion, we will promptly respond in accordance with laws and regulations, after verifying the individual's identity through prescribed procedures.
